Tragic Wishart sex trial of Alexander George O'Sachy to be heard by jury

A Brisbane man accused of having unlawful sex with a 15-year-old, who subsequently took her own life, today withdrew his application for a judge-only criminal trial.
Lawyers for Alexander George O'Sachy, 34, were in the Brisbane District Court with the intention of making an application that O'Sachy's February 2012 trial be heard and decided upon by a judge and not a jury.
However, barrister Jann Taylor, for O'Sachy, this morning told the court her client no longer sought a non-jury trial.
"It is accepted by both parties (the defence and Crown) the defendant (O'Sachy) is not seeking a no-jury trial," she said.
Ms Taylor said her client was originally charged with aiding in the suicide of alleged teenage victim.
She said further investigations suggested O'Sachy may be charged with the girl’s murder, but her client was subsequently charged with an offence of having unlawful sex with a girl under 16.
The maximum penalty for unlawful carnal knowledge is 14 years to life imprisonment.
The Courier-Mail last month revealed O'Sachy was ordered to stand trial in the District Court in the week commencing February 2, 2012, on a charge of unlawful carnal knowledge of a girl between August 8 and September 8, 2006.
O"Sachy, who sat quietly in the dock of Court 25 wearing a red jumper, long trousers and sporting a short hair style with a long rat's tail, was not required to enter a plea.
The court has been told the Crown case would rely on DNA evidence.
Prosecutor Glen Cash, during legal argument, said one proposed witness was expected to give evidence that O'Sachy and the child were involved in a "sexual relationship''.
The court was told O'Sachy is being held in prison for unrelated offences.
In September 2009, O'Sachy appeared before the Supreme Court in Brisbane on a charge of aiding in the 15-year-old girl's suicide.
O'Sachy pleaded not guilty to the charge and a jury failed to reach a verdict.
Justice Margaret White at the time discharged the jury and adjourned the matter for further mention.
Since then the Crown opted to prosecute O'Sachy on the sex charge.
During O'Sachy's Supreme Court trial, the jury was told that in 2006 the girl was found hanging from a rafter in the garage of a house she shared with him at Wishart, in Brisbane's south.
