Unemployed man escapes jail for downloading 15,000 child porn images
An unemployed man who downloaded more than 15,000 images of child pornography has been spared jail because his crimes were at the "lower end of the scale".
David Nigel Abbott, 26, of Valley View, was arrested after police raided his home and seized two computers in February 2007.
The District Court subsequently heard Abbot downloaded 15,790 images and eight videos after he was introduced to the images by a relative.
In sentencing today, Judge Peter Brebner said the majority of the material involved children younger than 14 in erotic poses or solo sex acts.
"If you had been more interested in the more serious forms of child pornography you would have gone straight to jail, it is as simple as that," he said.
Judge Brebner said the offences were aggravated because he "knew that at least some of the pornographic mages depicted children under the age of 14 or children apparently under the age of 14".
"You did not intend to download the more serious images and videos," he said.
He said Abbott suffered depression and was the primary carer for his bedridden fiance.
He said it was not clear if the images, 99 per cent of which did not depict children engaging in sexual activity, were obtained at one time of over a period of time.
Judge Brebner said Abbott had an interest in pornography since he was 16.
He said even the lowest category of child pornography "encouraged further exploitation of children" and needed to be punished.
He imposed a 12-month suspended sentence on condition of a $1000, three-year good behaviour bond.
