HOTEL resident who raped a nine-year-old girl in his room at a Fortitude Valley pub was jailed for 12 years today. A District Court jury in Brisbane took just under 90 minutes to convict Ioan Stoian of orally raping the girl on Septemer 6, 2008. It was the second time Stoian, 58, had been found guilty by a jury of the offence. In February last year, a District Court jury in Brisbane took several hours to find Stoian guilty of taking a child away for immoral purposes and rape. Stoian appealed and the Court of Appeal agreed the jury could not have been satisfied beyond reasonable doubt that the girl had been taken under threat. However, while it also set aside the rape conviction because of problems with the judge's directions and some of the evidence, the Court of Appeal ordered a new trial but only on the rape charge. In a new trial this week, the jury heard girl was with her father in the Fortitude Valley mall and went to a nearby store when Stoian approached her, and for some reason, she followed him back to a nearby hotel. The trial heard when the girl was in Stoian's room he threatened her with a knife and forced her to perform oral sex, but she screamed and fled when he allegedly tried to make her lie on his bed. In asking for the 12 years sentence, prosecutor Chris Minnery said it had been every parent's nightmare and had a major impact on the girl and her father. Before sentencing Stoian, Judge Leanne Clare asked if he had anything to say about the offence. "I didn't commit the offence, I didn't commit the crime," Stoian said. Judge Clarge said the victim had once been a carefree, naive, trusting little girl, but was now traumatised by the offence. She said oral rape was among the worst forms of the offence, and the courts had to impose sentences to deter the likeminded. The use of a knife had made the rape even worse, she added. Judge Clare said she accepted the girl had followed Stoian to his room probably because she thought he was going to give her something. She said Stoian had shown no remorse, sentencing him to 12 years' jail and declared he had served 921 days of the sentence on remand.
