Jason Donald Broadwater, a convicted child sex offender, pulled his pants down in a gutter on Waghorn Street, Ipswich and touched himself while watching a pornographic video. He was repeatedly told to stop but only desisted when police arrived. Broadwater, 39, performed the same act in Brisbane's Fortitude Valley the next morning. He pleaded guilty to two charges of wilful exposure and was fined $400. Magistrate Matthew McLaughlin expressed his frustration in court that he was only able to give Broadwater, who was on a suspended sentence for child sex offences, a small fine as police had failed to charge him with a more serious offence. But Shadow Attorney-General Jarrod Bleijie said the fine was “nothing short of shocking”. “For a convicted child sex offender to be allowed to walk free from court on a second offence of wilful exposure should be setting off alarm bells within the state's justice system,” Mr Bleijie said. “Spin and rhetoric will do nothing to stop these offenders. “Actions speak louder than words and until clear mandatory minimums and evidence-based rehabilitation programs are introduced, the government will keep handing out a slap on the wrist.” A spokesman for the Attorney-General's department last night said it was a matter for Queensland Police to appeal the sentence if they believed the penalty was inappropriate. A MAN who persistently fondled himself in the Ipswich CBD while watching explicit material on a portable DVD player has walked from court with a small fine. The 39-year-old pulled his pants down, sat in a gutter on Waghorn Street and touched himself while watching a pornographic video on the afternoon of November 10. Ipswich Magistrates Court heard a woman approached Jason Donald Broadwater, a convicted child sex offender, and told him to stop. But he responded by moving to a nearby park and continuing his lewd behaviour. Prosecutor Constable Tazania Lynch said Broadwater was still in full view of the public so the witness again approached him. “She told him to stop what he was doing as there were several women and young children in the area,” Cnst Lynch said. Broadwater pulled his pants up, moved a few metres to a tree and then continued “what he was doing”. Police arrived about 4pm and asked Broadwater if he thought his actions were inappropriate and he replied they were “definitely indecent”. But the next morning, police were called to Brisbane’s Fortitude Valley where Broadwater was engaging in the same behaviour outside a homeless welfare centre serving breakfast. Staff disturbed Broadwater but he rolled away from them and continued his actions. Broadwater pleaded guilty to wilful exposure and was fined $400. Convictions were recorded. The court heard Broadwater is currently on a suspended jail sentence for sexual offences against children. Defence lawyer Shay Duce said her client had suffered from a long struggle with alcohol and depression.
