PREMIER John Brumby will create a new law specifically for the crime of killing a child.
The dramatic move follows the horrific death of five-year-old Cody Hutchings and a spate of cases in which dozens
of Victorian children have been beaten to death by adults.
Community outrage over sentencing erupted again this week when the man who beat little Cody to death
in March last year was handed a 10-year minimum jail term.

Alarm Over Slaughter of Innocence
Australian infants are murdered at almost twice the rate of adults, prompting
calls for an urgent inquiry.
New research from the National Homicide Monitoring Project found that last year children under 5
were killed at a rate of 2.2 for every 100,000.
Adults are killed at a rate of 1.3 for every 100,000.
The study, by the Australian Institute of Criminology, also shows 32 children under
15, including an unborn baby, were killed last year.
Australian Childhood Foundation chief Joe Tucci said the slaughter of innocents demanded
urgent action.
Dr Tucci suggested a road toll style campaign to set targets for reducing child homicides
and an immediate inquiry by state and federal governments.
"When you have 28 homicides where the victims are four and under, you have murder
as the biggest preventable cause of child death," he said.
"The younger the child, the less likely they can defend themselves and of course
they are more at the mercy of the adults around them."
Dr Tucci said that drugs, mental illness and domestic violence were major factors in the tally.
Last year, 14 victims were under 12 months; of the killers, 13 were the victims mother.
In 26 cases, the killers were the child's parents.
In no case was the child murdered by a stranger. Half the cases were bashings.
Of 14 children killed in 2004-2005, four were slain in Victoria and five in NSW.
In Victoria, the overall number of homicides was down by 23 per cent.

In 1981 Paul Luckman and Robin Reid abducted two 13yr old schoolboys from Brisbane.
They drove the boys at knife/ gunpoint to Northern NSW.
There they degraded and tortured their victims before killing and burying one of the young boys.
Both Luckman and Reid were given life sentences.
In a disgusting outcome to this case- Paul Luckman claimed he was
"suffering stress" at the time of the murder.
Luckman had a sex-change operation at the expense of the Government and now lives as
Nicole Pearce. Was last known to be living in Melbourne.

His young victim was covered in more than a 160 bruises/ skull fractures/ tears to his liver/ abdominal injuries.

Shan Shan Xu, 34, has pleaded not guilty by reason of
mental illness (32yrs old- 2004). S.A.-
A WOMAN accused of murdering her four-year-old son yesterday wept in the dock
as video footage of him in the moments before his death were played at her trial.
Shan Shan Xu, 34, has pleaded not guilty by reason of mental illness to drowning
her son Stephen on March 31, 2003.
The NSW Supreme Court heard Xu intended to kill herself and her son when she
stepped off a wharf into the Parramatta River, near Sydney, with Stephen in her arms.
Closed circuit television footage taken at the wharf was played in the court.

Over a 10yr period, Folbigg smothered 4 of her own babies. 'SIDS' was thought to
be the cause of the first babies death....She was charged with
murdering 3 of her children/ manslaughter of her fourth child.
Folbigg has started (2004) an appeal on her sentence.

A WOMAN who killed her

has been found not guilty
because of mental
impairment.
Adele Denise Stuart,
38, fed Shaun Clancy, 2,
her anti-psychotic drug
and then smothered him
in March 2002.
A Supreme Court jury
yesterday found Stuart,
who suffers from schizophrenia, not guilty of
murder because of her
mental condition.
Justice Bernard Bongiorno ordered Stuart, of
Ascot Vale, to be held at
the secure Thomas Embling psychiatric facility.

A BRISBANE jury yesterday took less than two hours to find a father guilty of the savage
murder of one of his 10-month-old twin daughters.

A MAN charged with
the murder of a
15-month-old boy was
refused bail by a NSW
court yesterday.
Floyd Apollo Pacey,
24, of Wauchope, appeared in Port Macquarie Local Court on
the mid-north coast, charged with murder.
The charge related to
the death of the toddler
at Wauchope on New
Year's Day, police said.
Pacey was arrested in
Wauchope on Thursday
night. The court refused
bail. The case was adjourned to January 10.

They were killed on a custody visit.

Crespin Adanguidi - 27yrs old- A man who murdered the wife and two
children of his gay lover has been jailed for life.
Crespin Adanguidi, 27, had pleaded not guilty on the grounds of mental illness
to murdering the family of Raymond Shen, at Rockdale, Sydney, on Feb 1, 2003.
Justice Graham Barr said the motivr was robbery.

Killer Dad Stays In Jail
A butcher who killed and dismembered his newborn baby girl just minutes after her birth,
lost his bid for a re-trial yesterday.
The full bench of the high court in Canberra took less than a minute to find
Raymond Akhtar Ali, 52, had no right to freedom. Ali bashed Chahleen Amy Blackwell
to death minutes after her birth south of Brisbane, in September, 1998.

Plea To Keep Baby Torturer In Jail Longer
An 11-year jail term given to the killer of a baby boy was inadequate for a crime which involved
torture, including clamping the baby's toes, a Sydney Court was told today.
The NSW Director of Public Prosecutions is appealing against the sentence given to
Christopher Hoerler for the manslaughter of seven-month-old Jordan Anderson at Wagga Wagga
in the state's south west.

Six Years For Baby Killer
Stuart Thompson Clay- A Victorian man who crushed the skull of
his grizzling three-week-old son, was yesterday jailed for six years for manslaughter.
Stuart Thompson Clay, 32, was ordered to serve a minimum non parole
term of three years.
The Victorian Supreme Court heard Clay was nursing baby Zachery in his de
facto's home in Cobden when he fatally injured the child on March 11.
The court heard Clay was angry because he wanted to sleep and the baby was crying.

Little Teagen Ferguson cannot walk or talk.
And in three years when her father, Terrence
John Bice, who caused her permanent brain damage,
is released from jail, she will still be unable to walk or talk.
Yesterday, Bice was sentenced to five years jail
after pleading guilty to doing his little girl

Maryanne Jane Cooper- (NSW- Broken Hill)
Cooper, 21, who was suffering from postnatal depression/ also has an intelletual disability,
pleaded guilty to killing (infanticide) her baby daughter.
She was sentenced in September 2001 to a 4yr good behaviour bond/ undergo
psychiatric counselling. She suffocated her 7 month old daughter
and had also "entertained" thoughts of killing her first child aged 2yrs.

Foster, 40 (2001), was sentenced to 13 1/2yrs jail/ 10yrs non parole.
Convicted of the manslaughter of 3yr-old Peter Manikas, in June 1999.
Killed the young boy by kicking him in the liver....In August 2001,
Foster's appeal against his conviction was dismissed.

Rebecca Macaskill- (SA)
Convicted in a SA Supreme Court in August 2001.
Sentenced in August 2001 to 6yrs jail/ 3 1/2yrs non parole.
Macaskill, 23 (2001), shook her 3 month-old baby girl, Crystal, to death.
The baby was admitted to hospital with swelling of the brain and died three days later.
Crystal had previously suffered no less than 12 broken bones/ a brain injury.

A MAN who allegedly murdered
his two-year-old son before burying him in sand dunes at Port
Noarlunga had sole custody of four
other children aged under seven.
Children Youth and Family Services yesterday confirmed Benjamin
Martin David Green had custody of
five children, including two-year-old
Lachlan Peter Green whose body
was found on Sunday.

Green drowned his youngest child in the bath before
covering him in a plastic bag and burying him in the sand dunes.
Green was sentenced in November 2005 in the Adelaide Supreme Court to
life in jail/ 20yrs non parole. He will not be eligible for parole until 2024.

In February 2004 at a caravan site in Ravenswood, Gleeson murdered a
young mother (20yrs)/ her baby daughter (18months).
Gleeson, 34, was sentenced in September 2005, in the WA Supreme Court
to 28yrs jail.

Rosemarie Clark- (VIC)
"Whilst shaking (Amanda) she lost her grip on her, resulting
in (her) falling backwards onto the floor and hitting her head," Mr West said.
Rosemarie Clark pleaded guilty to conduct
endangering life and was placed on a three-year bond.

Sentenced in the Victorian Supreme Court in 1993 to 22yrs jail/ 18yrs non parole.
Convicted of murdering Daniel Valerio, aged 2yrs old.
Aiton was convicted of murdering the little boy
after he beat him/ he was taken to hospital were he later died.
Over a period of time Aiton had consistently physically abused the boy.

Guy Russell Gidgup- 51yrs- 2006 (WA)
Pleaded guilty in the WA Supreme Court. Sentenced June 2006 to life in jail/ 25yrs non parole for killing
a 16yr old girl and her mother (Gidgup's de facto partner).
The shooting murders occurred in January 2006, in Mandurah, WA.
Gidgup killed his de facto partner in her home/ shooting her daughter as ran screaming for help.
The couples 8yr old daughter escaped by running to a neighbours house.
Gidgup has never given an explanation for the murders.
