Former Detainee Jailed For Sex With Boy, 13
A FORMER Woomera detainee who had sex with a,
13-year-old boy at the Adelaide Aquatic Centre has
been sentenced to 34
months' jail and risks being
sent back to Afghanistan.
Hussain Haidari, a father of
four, met the teenager while
they were both swimming on
February 2 last year.
After a brief conversation
they had sex in the toilets and
met again the next day for the
same purpose.
In his sentencing remarks
yesterday, District Court
Judge Barry Kitchen said
Haidari's temporary visa
would likely be revoked if he
was sentenced to more than
12 months' jail.
The court was told Haidari
fled to Australia when the
Taliban gained control of his
village.
He made his way here after
fleeing a Kabul prison and
travelling to Pakistan.
From there, Haidari and his
sons travelled to Indonesia
and paid people-smugglers to
be taken to Australia by boat.
However, the vessel was intercepted and Haidari and his
sons were taken to the
Woomera Detention Centre.
They were eventually released on a
temporary protection visa shortly before the
offences.
Judge Kitchen said the offences were committed when
Haidari was depressed, Isolated and lonely.
He pleaded guilty last
month to four counts of unlawful sexual intercourse.
Judge Kitchen said
Haidari's limited English was
not an excuse for the offending
that be knew was immoral. "(The victim) states
that what occurred between
you has made life hard for
him, it has affected both him
and his family, and he wishes
it had never happened,"
Judge Kitchen said.
"That he was a willing participant is of little relevance.
"Children are to be protected
against the consequences of their immaturity
in such matters."
Judge Kitchen set a lower
than usual non-paroie period .
of 10 months after considering
Haidari's tragic background.
