Accused In Taped Sex Case Stays Put


A WARNERS Bay man charged with 13 counts of sexual assault and two of videotaping the acts for his sexual gratification was remanded in custody for a further four weeks yesterday when his appeal for bail was adjourned.
Darrin Michael Gillies, property developer and finance broker, of Margaret Street, Warners Bay, is alleged to have committed the offences at his home in April and on July 9.
In a statement tendered to Newcastle Supreme Court yesterday, police alleged that the woman, whose name was suppressed by the court, was an acquaintance of Gillies and was not aware of the sexual acts or taping.
Justice Roderick Howie said the "level of intoxication either by alcohol or drugs at the time the alleged offences were committed'' was in question.
Crown prosecutor Andrew Lynch had said the videotapes "were quite explicit in nature".
Mr Lynch said people in the video "could be identified along with other hard objects within the room".
Gillies was charged by Lake Macquarie detectives on Tuesday, two days after he returned from a three-week holiday in India, Sweden, Thailand and Lithuania.
The court was told that Gillies had a net worth of between $9 million and $11 million.
He had a large property and development portfolio and owned Oceana Financial Services at Mayfield and "a large ocean-going yacht".
Police told the court that Gillies could use the yacht to leave the country, which he denied.
Solicitor Paul Rosser, for Gillies, said his client was "tied to the community" through his business interests and posed no threat to the community or his accuser.
Justice Howie said given that the prosecution case appeared to be strong and that the Crown and defence cases needed more attention he would adjourn the appeal for bail until August 26.
