Paedophiles Refusing To Reform Their Ways Will Die In Jail
Paedophiles who refuse to be rehabilitated will be locked up
for good under a plan by South Australian Premier Mike Rann
that matches ALP moves in Western Australia.
“Geoff Gallop and I often think alike and I applaud his tough
move on paedophiles,” says Mr Rann.
“Our Government will introduce new legislation that increases
penalties against repeat paedophiles and effectively locks them up for good.
“We will adopt Geoff Gallop’s idea that allows the Attorney-General
to apply for a detention order from the court forcing serious sexual
offenders to stay in custody beyond their sentenced time.
“Our proposal also cracks down on paedophiles in three other ways.
“It includes a two strikes and you’re out policy, rather than the current
system of three offences for a court to declare someone a serious repeat
offender incurring heftier sentences and longer non parole periods.
“Sex offences considered under the two strikes you’re out policy will
include rape, unlawful sexual intercourse, indecent assault, acts of
gross indecency, sexual servitude and persistent sexual abuse of a child.
“We will also broaden the law for those found incapable of controlling
their sexual instincts, to those who are found by two psychiatrists to
be unwilling to control their sexual instincts. Those who refuse a
court-ordered independent examination by a psychiatrist will be
deemed unwilling.
“The Supreme Court will be given the authority to detain those
incapable or unwilling offenders indefinitely. If they remain a
threat to our children then they deserve to stay in jail.
“I want to send a message to the courts that we want a much
tougher sentencing regime imposed on sexual predators who
refuse to correct their ways,” says the Premier.
Attorney-General Michael Atkinson says the Government will
also put ‘child protection’ at the top of the list of
considerations for judges through amendments to the
Criminal Law (Sentencing) Act.
“In addition, where the Act sets a higher penalty for
offences against children under 12 years, that age will
be raised to children under the age of 14,” says Mr Atkinson.
“Although a person who has sex with a person under
the age of 12 can be imprisoned for life, under the
proposed changes the maximum penalty of life imprisonment
would also apply to unlawful sexual intercourse with a 12 or 13 year old.”
The major reforms are expected before Parliament later this year.
