Sentence: Sentenced in August 2003 in the Bendigo Magistrates Court to 12 mths jail/ 6 mths of sentence suspended. Dudkowski was released on bail 1 day after sentencing to appeal his conviction. To be updated.

Offence/Other: Convicted on a number of child pornography charges. Dudkowski encouraged the girl to wear revealing underwear he bought.He then took her back to his place and photographed her in the underwear. Dudkowski attempted to blame the situation on the child.Victim was an 8 yr old girl.

Child Porn Charges Appealed

A Bendigo man who photographed an eight-year-old girl in a sexually suggestive pose faced court yesterday to appeal child pornography charges. Christian Dudkowski, 58, of Mitchell Street, faced the Bendigo County Court appealing a jail sentenced imposed on him in August, last year.
The defendant pleaded guilty to one count each of possessing and making child pornography, but is pleading not guilty to a count of procuring a child for purposes of child pornography.
In August, last year, the defendant was sentenced in Bendigo Magistrates Court to 12 months jail/ suspended for six months.
The court heard during a shopping trip in July, 2002, Dudkowski bought the girl a G-string.
Prosecutor Greg Connellan said the defendant had taken three photos of the victim in indecent poses using a disposable camera at his house.
The girl knew Dudkowski well and was often entrusted to his care.
Police were alerted to the photos and conducted a search of Dudkowski's flat on August 14, 2002.
Officers did not find the photographs in Dudkowski's flat.
He told police he had destroyed them because they made him feel uncomfortable.
Defence counsel Chris Durston said his client had indicated the victim wanted the G-string, which he then purchased.
After taking the photos, Mr Durston said his client felt "disgusted" at his actions.
Mr Durston said his client had an extensive criminal history, "but nothing of this nature,"
Mr Durston called for his client to receive a wholly suspended sentence. "These photos stand on their own. They're not part of a chain of events," he said.
Mr Durston successfully made a request to Judge Graeme Andersen to close the court to the public so further evidence could be tendered.
On reopening court, Judge Andersen said the defendant's application tor appeal would be adjourned until further evidence was available for investigation.
The case was adjourned to October 25, in Melbourne.
