Year's Jail For Child Porn Collection
A ST Albans Park man with a prior for possessing kiddie porn has been jailed
after being caught again.
Damien Child, 46, of Ellstone Ave, pleaded guilty
in Geelong County Court yesterday to one count of
knowingly possessing child
Crown prosecutor Tim Walsh said that in May last year police executed a search
warrant on Child's home where 31 disks were found in a wardrobe.
He said the disks contained images of sex acts on young males.
Mr Walsh said another 24 images of child pornography were on Child's computer.
"Altogether 500 pornographic images and 60 pornographic movies were found but
it is unclear exactly how many were child pornography," Mr Walsh said.
David Gray, for Child, said the 24 sample images submitted in evidence were not
Mr Gray, who described Child as a computer-expert, said that when
accessing "a basket" of information on the net, his client did not
know exactly what he was getting.
"He also says that when police seized material from his home in 2003,
they did not search the property and seized only material found around
his computer," Mr Gray said.
"But he had backed all of it up and this was stored in a cupboard so it
is stuff he has already been tried, convicted and sentenced over."
Mr Gray said his client admitted he had "dabbled" again and did not shy
away from the imposition of a prison sentence, but asked that it be served
in the form of another intensive corrections order.
But the Crown prosecutor called for an immediate custodial sentence.
"The defendant was given an opportunity last time and did not take it and
here he is, at it again," Mr Walsh said.
In November 2003, Child was convicted in Geelong Magistrates' Court after
pleading guilty to possessing child pornography.
On that occasion he claimed he had accidentally downloaded the material while
downloading music and science fiction from the internet.
The charge related to the seizure of 23,000 graphic images, 180 of which were
child pornography showing images and movies of children as young as three and
four years being sexually penetrated.
On that occasion Child was convicted and sentenced to eight months' jail to be
served in the form of an intensive corrections order.
In sentencing yesterday, Judge Leslie Ross said the latest images
showed "a quite depraved sexual exploitation of young children".
He convicted Child and sentenced him to 12 months' jail with a
non-parole period of six months.
Child will also remain on the
sex offenders register for 15 years.
