Ex-guard at Australian Jewish school appealing rape conviction

David Cyprys was handed eight years in prison for sexually assaulting nine boys in the '80s and '90s.
A convicted pedophile who sexually molested students at an Australian Jewish school for boys where he worked filed an appeal last week.
David Cyprys, a former security guard at Yeshivah College in Melbourne, was sentenced to a prison term of eight years in December for sexually assaulting nine boys in the 1980s and 1990s. In August, a jury found him guilty of five charges of rape against one former student before he pleaded guilty to 12 charges of assault against eight others.
Cyprys, 45, is contesting the rape conviction in the Court of Appeal.
“These five counts of rape refer to a single individual," his wife, Michelle Coleman, said in a statement. "I can say that it is the same individual who made a claim of touching, not rape, against David in 1991, to which David pleaded guilty and paid a $1,500 fine.”
The only victim to go public, Manny Waks, said the appeal “would no doubt have a detrimental impact on some of Cyprys’ many victims. Many would want to move on from this difficult period, but he is now causing us to relive the trauma he inflicted upon us.”
Waks added, “It also highlights the lack of remorse by Cyprys, something the judge pointed out during the case. I am confident that justice will prevail, again.’’
Cyprys must serve 5.5 years of his sentence before being eligible for parole.

Former Jewish school worker jailed for child sex abuse offences
David Samuel Cyprys

A former worker from a Melbourne Jewish college has been sentenced to eight years in prison for a string of sexual offences.
David Samuel Cyprys, 45, who worked in various roles at the Yeshiva College, admitted to interfering with nine children at the school in offences dating back to the 1980s.
Though several of the offences were committed while Cyprys was a minor himself, his offending continued until his 20s.
He was convicted in August of five counts of rape and pleaded guilty to additional charges including indecent assault and gross indecency.
Cyprus will serve a minimum term of five-and-a-half years before he is eligible for parole.
He will also be put in the sex offenders register.
The Yeshiva college has been widely criticised for not acting earlier on complaints against Cyprys.
Manny Waks, who campaigns against child sex abuse, said outside the court that he will take civil action against the college after being given court approval to publicly declare that he was one of Cyprys' victims.
"I've lived for decades in silence, shame, guilt and I'm very pleased that the judge today accepted my application," Mr Watts said.
"I don't want to hide behind anything any longer, this is who I am, this is what happened to me and David Cyprys is responsible for that."
Cyprys is the second paedophile to be convicted of abusing students at Yeshivah.
In July, Rabbi David Kramer was jailed for abusing four boys at Yeshivah in the early 1990s.
Victoria Police criticised the school for helping Kramer escape to the US.

Security guard David Samuel Cyprys assaulted nine students at Yeshiva College

A former security guard of an exclusive orthodox Jewish college assaulted nine students there, it can now be revealed.
David Samuel Cyprys, 44, was employed as a karate instructor and security guard at prominent Yeshiva College when he abused some of the students.
Other students were abused while Cyprys was on a youth camp organised by the Yeshiva Centre. The Herald Sun can today reveal Cyprys was continued working at the school despite being found guilty of indecent assault in 1991.
Cyprys was fined $1500 and placed on a good behaviour bond, without conviction, after appearing at the Prahran Magistrates Court in 1992.
Cyprys was later charged with more than 40 offences spanning the 1980s and 1990s against children aged between seven and 17.
He has been standing trial in the County Court since last month but a blanket suppression order prevented any details of the proceedings being reported.
It can now be revealed Cyprys, who was set to face three separate trials, was found guilty by a jury of five charges of rape against one former student after the order was this morning revoked.
Cyprys pleaded guilty to a further 12 assault-related charges against eight other complainants.
It is the latest in a string of child sex scandals to rock the college. In July former teacher David Kramer was jailed for "unforgivable" crimes on four students at the school.
The 53-year-old pedophile was the first member of a Jewish institution in Australia to have admitted - and been sentenced for - child sex crimes.
Kramer pleaded guilty to molesting four boys while teaching at Yeshiva College in the early 1990s before fleeing to the US, where he was jailed for further offending.
The school has come under fire for allegedly covering up sickening crimes against children. Senior officials have publicly admitted they helped Kramer flee Australia after rumours started circulating that he had abused students.
Shortly after Cyprys's arrest in late 2011 police hit out at some members of Melbourne's orthodox Jewish community saying they had actively tried to protect Cyprys from authorities.
Giving evidence at a bail application hearing informant Senior Detective Lisa Metcher told the Melbourne Magistrates Court sections of the Jewish community had hindered the police investigation.
"They have failed to act in any way to protect the children and the matters have been swept under the carpet," Sen Det Metcher said "Lies have been told to police ... information has been twisted or covered up," she said.
Former principal Rabbi Abrham Glick last year admitted he knew in the early 2000s of rumours that Cyrprys had abused students.
Rabbi Glick was in charge of the college between 1986 and 2007 and still holds one of the most senior positions at the school.
Cyprys has returned to court today for a plea hearing. The matter continues.

Rabbi ignored warnings on sexual abuse, say parents

One of Australia's leading rabbis told a man whose son had been allegedly sexually abused by a youth group leader at a Melbourne Jewish school that the child would not need counselling because he was under eight years old, court documents say.
David Samuel Cyprys, a former security guard at the Yeshivah Centre in St Kilda East, has been charged with 53 offences, including six counts of rape, allegedly committed against 12 boys between 1982 and 1991.
He is contesting the allegations at a committal hearing in the Melbourne Magistrates Court.
David Samuel Cyprys
In court documents, the parents of two separate boys said they went to Yeshivah Centre director Rabbi Yitzchok Dovid Groner in the 1980s to complain about alleged molestation.
The parents of both boys said no action was taken, with one woman saying her son was abused for another three years after her complaint.
One father said he told Rabbi Groner in 1984 that Cyprys had ''interfered'' with his son. '' He told me that [the boy] wouldn't need counselling because [he] was under eight years old,'' the man said in a statement.
''Rabbi Groner told me he had spoken to psychologists before and they had told him because the children are so young counselling would not be necessary. Since that day I never heard another word.''
The mother of another boy said she called Rabbi Groner in 1987 after being ''shocked out of my brain'' to learn of alleged abuse of her son.
''I recall when I mentioned David Cyprys' name to Rabbi Groner he replied, 'Oh, no, I thought we cured him'. By this I was sure that Rabbi Groner meant this sort of thing had happened before with David Cyprys,'' the woman said in a witness statement.
Rabbi Groner, who was Melbourne's most senior Chabad rabbi, died in 2008.
The court documents say Cyprys, who owns a locksmith business, has been affiliated with the yeshivah for many years. He was employed as a security guard, was a co-leader of a Jewish youth group there and was a martial arts instructor who recruited students from the school.
Cyprys, 44, of Balaclava, also supervised young males at the mikvah baths attached to the Yeshivah Centre, which are used for the spiritual cleansing of Jewish males.
''The accused was seen as a role model by members of the Jewish community who trusted him in the company of their children,'' the summary of charges says.
The alleged victims, who were aged between seven and 17, say they were abused by Cyprys at locations including the mikvah bath house, Elwood houses, his van, Gan Israel youth camps and Yeshivah College.
''He was known as the 'key master'. People knew this, and still do, and we were afraid of his reputation as being able to access everybody's houses and also because of his martial arts prowess,'' one alleged victim said in his statement.
''Cyprys was never shy about touching up kids. He was never violent, but you were scared, because he had the keys to everything, and he was a black belt at karate.''
Another alleged victim said Cyprys was ''a lot bigger and stronger than me at the time''. ''He had me pinned and cornered. I felt sick to my bones and wanted to die, I was so afraid.''
The man said that in the US, paedophiles in the Jewish community were reported to the police and dealt with accordingly. ''For some reason, the Jewish community in Melbourne covers things up,'' he said in his statement.
Rabbi Abraham Glick, who was the principal of Yeshivah College between 1986 and 2007, said he had no recollection of any child or parent making a complaint to him about Cyprys molesting children.
''More recently it became known that the students did talk about David allegedly molesting children, but amongst the children there was a code of keeping this in 'their world','' Rabbi Glick said in his statement.
''The children did not discuss these issues with adults.''
Rabbi Glick, who still teaches at Yeshivah College and is the head of student wellbeing, said ''attitudes at the time were very different to current attitudes''.
''In those times it was a general practice that parents would not discuss these type of issues with anyone other than Rabbi Groner in his capacity as rabbi of the community and director of the colleges.''
The committal hearing is continuing before Magistrate Luisa Bazzani.

Synagogue asks alleged child molester to stand down

A security guard accused of sexually abusing boys from an Orthodox Jewish school in St Kilda East has been asked to stand down from the board of management of an Elwood synagogue until a police investigation into alleged paedophilia at the school is completed.
Several former students of Yeshivah College have lodged statements to police alleging they were molested by David Cyprys, a security guard who also taught karate.
Mr Meinrath said Mr Cyprys had a current government permit to work with children. But he said he had asked him to stand down voluntarily until the police investigation into alleged abuse at Yeshivah College was over. ''We will not take any further action until we know one way or another,'' Mr Meinrath said.
Mr Cyprys continued to work alongside children at Yeshivah Centre, which runs the school, despite pleading guilty to indecent assault in 1992. No conviction was recorded, but he was fined $1500 and ordered to be of good behaviour.
The former Yeshivah Centre director, Rabbi Yitzchok Dovid Groner, was told of sexual abuse complaints against Mr Cyprys as early as 1996.
Mr Cyprys's private security licence states he is employed by Yeshivah Centre.
