Teacher Sex School Sued

A private school is being sued by the family of a student who became involved in a sexual relationship with her teacher.
Court documents reveal the family is pursuing unspecified damages against the school - and the teacher - over the incident which happened almost three years ago.
The Sunday Mail understands the civil case is the first in South Australia to question a school's' responsibility for a teacher's actions.
Father-of-two Gregory Fletcher is serving a 4 1/2 year non-parole period for having an unlawful sexual relationship with the girl, then 14, at Unity College, Murray Bridge.
The family, who cannot be identified for legal reasons, also claims family members - including two siblings - suffered mental distress since the ordeal and were forced to move house.
They also claim the victim's capacity to leam has been reduced and she will, therefore, be affected in later life.
The girl's mother told the Sunday Mail the family had still not recovered from the ordeal.
"We have moved house just to get a new start," she said. "I doubt whether my daughter will ever be the same again.
"She was a straight-A student - now she's a wreck."
The mother said the family "want it all to end" but was intent on pursuing the civil action.
"Money is not going to fix it but we want the school to be held responsible," she said.
In its defence filed in court, the school denies negligence and questions whether the girl is still affected by the relationship, which continued for 12 months.
"She has sufficiently recovered from her injuries such that she no longer experiences pain and suffering.." the defence claims.
"Or, alternatively, if she does suffer pain and loss of amenities, such pain and loss... is minimal."
The school also argues the girl has "sufficiently recovered" and is "not suffering any impairment to her earning capacity".
Giving evidence in court in August, 2001. the girl said "the innocence of childhood has left me".
"All I can think is love is not all It's cracked up to be," she said.
"I feel as if there's nothing that will ever repair me and the tears will never stop."
Fletcher was first employed by the school as a probationary teacher and began an "inappropriate relationship" with the girl within six months.
The school admits it became aware of this when the victim's mother found a "love letter" and confronted the teacher. Five months later, the school issued a written warning to Fletchcr but did not remove the victim from his care, the 2001 hearing was told.
In its defence, the college said it "did not know nor have any reason to suspect that the victim was at any risk being left in the first defendant's (class)".
The family claims Fletcher "continued to foster a relationship" over the next six months and the pair was soon engaging in unlawful sexual intercourse.
The family also claims Fletcher is responsible for abusing his position of trust and for committing the unlawful acts.
The matter has been adjourned until next month so further medical opinions and reports can be lodged.
Fletcher has not yet lodged a response to the family's claims.
Court documents filed on behalf of the family also claim the school failed to protect the student from the teacher despite knowing of the teacher's preliminary actions.
