James Patrick McGrane, jailed over the rape and murder in 1986 of his sister, fails in bid for review of parole decision

A Darling Downs man who has spent all his adult life in jail for the rape and murder of his sister more than 25-years ago has lost his bid for court-ordered review of his parole.
Brisbane Supreme Court judge David Boddice on Thursday dismissed James Patrick McGrane's attempt to force the Queensland State Parole Board to review its decision to refuse him release on parole.
McGrane, 43, was 17 years-old when he pleaded guilty to the rape of his sister, 21, whose bound body was found at Hodgson Vale, 17 km south of Toowoomba, on the Darling Downs, on March 26, 1986.
McGrane pleaded not guilty to a charge of murder on the grounds of diminished responsibility but a Supreme Court jury found him guilty.
He was subsequently sentencing to life imprisonment.
The trial heard McGrane led the woman upstairs to a bedroom in a shop, tied her feet and hands together and gagged her with a piece of medical tape.
He then cut her clothing off, raped her and stabbed her to death.
McGrane has applied for parole on several occasions but been refused.
Justice Boddice dismissed McGrane's application for a statutory review of the matter, but his written reasons were not made immediately available.
McGrane, dressed in a light grey tracksuit, long white socks and an old pair of joggers, did not show any emotion or make any comment as he sat in the dock of Court 12 for the delivery of the decision.
Lawyers for the Parole Board asked that McGrane be ordered to pay the costs for the failed application.
However, Justice Boddice denied the request, saying McGrane had never spent one day of his adult life out of prison, was likely to have no assets and had every right to have his day in court.
"Mr McGrane has been in prison a very long time ... (and) was entitled to bring the application," he said.

Murderer-rapist in new bid for parole

A convicted murderer and rapist has launched a bid for a judicial review into a decision to deny his parole.
James Patrick McGrane was 17 when he was jailed for 15 years for rape and a life sentence for the murder of a woman near Toowoomba in 1986.
In jail, McGrane committed further offences such as attempting to escape from lawful custody, damaging his prison cell and fighting with other inmates and guards.
He was first eligible for parole in 1999 and has made multiple unsuccessful applications to the Queensland Parole Board since 2002.
Authorities say McGrane, who has been classified as a high security inmate for much of his jail term, lives in isolation "in his world of fantasy" and was posed an unacceptable risk to the community.
However McGrane, who has completed several university courses while in jail, has taken his fight for release to the Brisbane Supreme Court.
Representing himself, he argued his case by phone this morning, telling the court the decision to deny him parole had been made in "bad faith".
"There's a number of factors I want to bring forward," he said from Wolston Correctional Centre.
"The respondent [parole board] hasn't considered the merits of my case."
Justice John Byrne ordered McGrane to file an outline of his arguments to the court by February 4.
