Sentence: Sentenced in Dec 2004 to a 2 yr community based order/ continue psychiatric treatment/ Placed on sex offender register for the next 8yrs.

Other: Psychologist. Pleaded guilty to 1 charge of possessing child pornography, on the 10-10-2004 in the Heidelberg Magistrates Court. 114 child pornography (sexually explicit) images of boys (aged between 8-14 yrs old), were found on his home computer/ detailed notes of his fantasies. Provan Used his credit card to access child porn sites. Arrested as part of Operation Auxin in September 2004.

Provan avoids jail over porn possession

A Melbourne psychologist convicted of possessing child pornography on Thursday avoided a jail term.
James Anton Provan, 38, last week pleaded guilty in Heidelberg Magistrates Court to one count of possessing child pornography.
The charge was laid after police found 114 sexually-explicit photos of boys under 18 on his computer hard-drive.
Magistrate Jillian Crowe on Thursday placed Provan on a two-year community-based order and ordered him to continue treatment with a psychiatrist.
He will also be placed on the serious sexual offenders register for eight years.
Ms Crowe said because Provan sought treatment for his offending prior to detection and pleaded guilty she did not feel it was necessary to jail him.
"Clearly you had embarked on efforts to curtail your activities and indeed your fantasies and for that you are to be commended," she said.
The court was told police seized a computer containing the images, notes detailing Provan's sexual attraction to children and an article titled `The Mind of a Paedophile' when they searched his home in Kemp Street, Thornbury, on September 27 this year.
Provan's lawyer Steven Pica told the court his client felt guilt and self loathing over his crime and had sought psychiatric help to address his problem before he was detected.
He said Provan's life had been turned upside down, he had brought shame to his family, lost his job and his image has been posted on national television over his offending.
Provan is one of at least 191 people charged or facing charges around Australia as part of operation Auxin, a joint crackdown by state and federal police on internet child pornography.

Porno Case Begins

A child psychologist yesterday became the first Victorian to appear in court over the national crackdown on child pornography.
James Provan, 38, is one of about 180 Victorians investigated by police as part or Operation Auxin.
Charges allege more than 100 extremely explicit pornography images had been downloaded from the internet on to a computer seized by police from Mr Provan's Thornbury home.
The images involve boys under the age of 10 engaging in sexual activity with one another or posing in a sexually suggestive manner.
Each image showed between one and five boys.
Northcote CIU detectives also seized a large number of documents and computer discs in an early morning search on Mr Provan's home in Kemp St on September 27. Mr Provan. a government-employed manager, appeared in the Heidelberg Magistrates' Court yesterday charged with one count of possessing child pornography.
He was charged as a result of an FBI investigation conducted in America in relation to Russian provided pornography.
Mr Provan allegedly subscribed to Regpay the US company investigated over distributing the images.
Company records seized by US authorities revealed the names of subscribers, which were then supplied to Australian Federal Police.
Mr Provan is one of 68 Victorians charged after more than 500,000 images of child porn were seized.
Appearing without his solicitor, Mr Provan consented to a police application he lodge a $2000 surety on his bail.
"I have the money with me," he told magistrate Max Cashmore.
Mr Provan is due back in the court on November 11.
