Longer jail Sentence For Rape of 84-year old
THE Court of Criminal Appeal has
increased the jail sentence of a man
who brutally raped an 84-year-old
Riverland woman.
The court yesterday ruled 2-1 the
sentence imposed on 33-year-old
John Siozios fell "so far short of an
adequate penalty" it should be increased immediately.
The eight-year sentence was increased to 11 years, and the court
imposed a 6 year non-parole period.
In the majority judgment, Justice
John Perry said Siozios had deliberately targeted the victim's unit from
among a block of aged-care flats with
the intention of raping her.
The assault, in August 2002, was
"accompanied by violence throughout" and "has had lasting effects" on
the victim's peace of mind. Justice
Perry said a 13-year term was appropriate, reducing it by two years for
Siozios' guilty plea.
Justice Perry's ruling was supported by Chief Justice John Doyle.
Justice Richard White, dissenting,
agreed the original sentencing judge
had made several "errors of fact".
But he said the sentence, while
lenient, did not involve "an erosion of sentencing standards".
