Dungeon rapist Michael Pilgrim who chained victim in five-day ordeal wins a five-year cut to his sentence

A rapist who kept his victim chained to the floor in a soundproof dungeon will get out of jail five years earlier after winning an appeal against his sentence.
Aeronautical engineer Michael Pilgrim was jailed last year for 23 1/2 years with a minimum of 19 years for the horrifying five-day ordeal he inflicted on his victim.
The deranged pervert had pleaded guilty to rape, abduction, stalking, theft and child pornography offences at the Victorian County Court. Today a Court of Appeal reduced his sentence to 18 years with a non-parole period of 14.
The court ruled his sentence was manifestly excessive due to the cumulation of the various jail periods handed out.
“In our view, the aggregate sentence imposed does fall outside the range reasonably open,’’ court documents state.
During his trial, the court heard after becoming obsessed with his victim, Pilgrim abducted her with a stun gun and drove her to a rural property he'd rented under a false name.
He meticulously planned the kidnapping and when he was ready to pounce dressed in disguise and raided a house he tracked her to in Frankston, stunning one of her friends before abducting her in a white van.
Pilgrim told a psychologist after his arrest that the crime “looked a lot worse than it is”.
The attack occurred at a rural house at Drouin, about 100km east of Melbourne, in July 2012.
Pilgrim had created false identities to rent properties and cars, bought chloroform over the internet and tracked the woman and her sister by placing bugs on their cars.
In early July, he dressed in disguise and raided a house he had tracked his victim to Frankston.
After attacking her friend and snatching his victim, he drove her to the isolated house, where he had previously built a soundproof room he dubbed “the cubby house”, chained her to the floor and repeatedly raped her.
He told the woman he would harm her and wanted to be killed in a police shootout.
“This is not about money, I want to hurt you,” he told the woman.
“You’d better not play up because I really feel like carving someone up today.”
He held the woman for five days, before he took her to a hospital and fled to NSW.
When he was eventually arrested, police discovered he had a about 100 other people under surveillance and was in possession of bomb-making material and torture manuals.
At the time of handing down the sentence Judge Michael Tinney said it was chilling to comprehend the level of planning behind the attack and the fear Pilgrims victim would have felt.
“She thought she was going to die,” he said.
Judge Tinney said Pilgrim, a former St Kevin’s College student, had a good upbringing but had developed a level of social isolation.
He said Pilgrim was unable to understand the seriousness of his crime or the level of impact it had on his victim.
The court heard Pilgrim had only slight prospects of rehabilitation and posed a moderate to significant risk of reoffending when released.
Pilgrims parents wept as the sentence was handed down, but the court heard he had not allowed them to visit him in prison, and he did not look at them as he was led away from the prisoner’s dock by guards.

Rapist Michael Pilgrim led life of evil with 100 people being stalked

An aeronautical engineer who stalked, abducted and raped a woman at an isolated property had 100 other people under surveillance when he was caught, the County Court has heard.
Michael Pilgrim, 34, yesterday pleaded guilty to rape, abduction, stalking, theft and child pornography offences at the Victorian County Court.
Prosecutor Brett Sonnet said it was "extremely serious offending" and called for Pilgrim to be jailed for up to 22 years.
Judge Michael Tinney had earlier agreed Pilgrim would be given a long sentence.
When he was eventually arrested, police discovered Pilgrim had another 100 people under surveillance.
He also told the victim he planned to abduct prostitutes from the Daily Planet and Gotham City brothels.
The court heard the victim - who was sitting in court as her ordeal was detailed - was kidnapped in July 2012 after she stopped work as a prostitute and began a long-term relationship.
Pilgrim meticulously planned the kidnapping, creating false identities to rent properties and cars, brought chloroform over the internet and tracked the woman and her sister by placing bugs on their cars.
Pilgrim abducted the woman and drove her to an isolated house near Drouin, where he had built a soundproof room he dubbed "the cubby house", chained her to the floor and repeatedly raped her.
He told her he would harm her, and wanted to be killed in a police shootout.
"You'd better not play up because I really feel like carving someone up today," Pilgrim told her.
He held the woman for five days before he took her to a hospital and fled to NSW.
Pilgrim was found to be in possession of bomb-making materials and torture manuals when he was arrested.
Defence barrister Greg Hughan said Pilgrim had only ever had relationships with prostitutes and had taken a "Stockholm syndrome approach" to convince the victim to continue seeing him.
Judge Tinney said Pilgrim's reason for offending was "totally warped".
"The extraordinary level . . . of premeditation sets (this offending) apart from most crimes we've heard in this court," Judge Tinney said.
Pilgrim will be sentenced on August 27.

But defence lawyer Greg Hughan said Pilgrim's actions were a misguided attempt to win the love of the only person he felt he had ever had a romantic relationship with.
When he met his victim, a sex worker in St Kilda, Pilgrim got along so well with her he began seeing her exclusively, the court heard.
When she ended the arrangement, Pilgrim felt "dumped".
"He formulates a plan in which he thinks `I'll win her back'," Mr Hughan told the court.
He took her to the rural property, padlocked her to the floor and told her he planned to keep her there to use her.
Mr Hughan told the court the victim only spent about an hour in the "cubby house".
He said Pilgrim was not mentally ill but was incapable of understanding the impact of his behaviour on other people.
The court heard Pilgrim told a psychiatrist: "This offending looks a lot worse than it is."
Pilgrim, 34, of no fixed address, has pleaded guilty to a string of charges including four counts of rape, one count of false imprisonment, abduction and stalking.
He also pleaded guilty to possessing explosive devices and child pornography material.
The victim escaped after he took her to a local hospital when she complained of severe stomach pain.
He was apprehended in Sydney before being extradited to Victoria.
The prosecution has called for a jail term of 19 to 22 years while the defence says he should serve a minimum of 11 years.
Pilgrim will be sentenced on August 27.

A man allegedly used a disguise, a fake driver's licence and chloroform, to track and abduct a woman he kept in a soundproofed room on a rural Victorian property.
Michael Allen Pilgrim, aka Mark Darcy, kept the woman chained up for five days in a soundproof "cubby house" he purpose-built on a Drouin property where he repeatedly raped her, the Victorian County Court heard.
Prosecutor Brett Sonnet told the court Pilgrim, a former aeronautical engineer, was highly educated and was meticulous in planning the July 2012 abduction.
Pilgrim created a range of false identities, ordered chloroform and nitric acid online and researched torture techniques, uses for prescription drugs and how to construct and use a propane crematorium, he said.
Mr Sonnet said Pilgrim, who came to know the woman when she was a sex worker, placed GPS-tracking devices on the victim's car and her sister's car, later telling her that if she tried to harm herself he would go after her sister.
Wearing a fake beard and hi-visibility vest he tracked her to a friend's house, tasered the man who answered the door when he knocked, then struck him on the head with a pistol.
The prosecution alleges he then made the victim get into a car, threw her phone out the window and stabbed the electronic chips in her bank cards.
The court heard Pilgrim told her: "You better not play up because I really feel like carving someone up today."
He took her to the rural property, padlocked her to the floor and told her he planned to keep her there to use her.
Pilgrim, 34, of no fixed address, has pleaded guilty to a string of charges, including four counts of rape, one count of false imprisonment, abduction and stalking.
Pilgrim also pleaded guilty to possessing explosive devices and child pornography material.
The 25-year-old victim escaped after she complained of severe stomach pains and told Pilgrim she had had a termination.
He allowed her to go to Warragul hospital, where she was diagnosed as having suffered an ectopic pregnancy.
Pilgrim attempted to contact her via a Facebook alias while she was in hospital.
He was apprehended in Sydney before being extradited to Victoria.
The plea hearing continues.

Woman abducted, imprisoned in rape ordeal

A man who abducted, imprisoned and repeatedly raped a woman over five horrifying days was motivated by the hope she would develop Stockholm syndrome and fall in love with him, a court has been told.
Michael Allen James Pilgrim, 34, abducted the woman from a Frankston house on July 5 last year, put her in a car boot and imprisoned her in a soundproofed room in a secluded Gippsland house, where he raped her daily and she feared she would be killed.
Prosecutor Brett Sonnet called on County Court judge Michael Tinney to impose a sentence of between 19 and 22 years given the nature of the crimes and the sophistication of their planning.
The court heard on Thursday that so meticulous was his planning in the months beforehand, he created false identities to acquire rental cars and a remote house in Drouin, kept the woman under constant GPS surveillance, researched the best time of day to abduct someone and read up on disguises and torture techniques.
Mr Sonnet said when Pilgrim was arrested, in Sydney, 10 days after leaving the woman outside a Warragul hospital, he was found in possession of more false identities and was keeping surveillance on "hundreds" of other people.
Upon being extradited to Victoria, the court heard, Pilgrim told a prison psychiatrist his offending "looked a lot worse than it was" and that he was angry at the money he had spent previously on "filthy, deceitful whores".
The court heard the woman was a sex worker and that Pilgrim was a regular client until February 2011, when she stopped working to commit to a relationship with another man, which angered Pilgrim.
But the court was told instead of a vengeful attack, Pilgrim hoped by abducting the woman and imprisoning her that she would develop feelings for him.
Defence counsel Greg Hughan said Pilgrim's only adult relationships were with prostitutes, and that he loved the woman.
Mr Hughan acknowledged in Pilgrim's "warped view of the world" he "formed a plan to win her back" and hoped the woman would develop feelings that other hostages had for their abductors.
"That was what he had on his mind when he carried out the plan and completed these dreadful offences," Mr Hughan said.
He said Pilgrim's actions were tragic and "terribly sad" for both the abductor and his victim, and that his client regretted that he would never have a relationship with the woman.
Mr Sonnet said Pilgrim held the woman against her will one day in November 2011 but freed her, but then spent the first half of 2012 plotting to abduct her.
He said Pilgrim acquired a stun gun, knife, fake pistol and chloroform and tracked the woman's car and her sister's car with GPS devices. He prepared the house in Drouin by fixing an eye bolt to the floor and attaching mattresses to the walls in a room he called the "cubby house".
Mr Sonnet said on July 5 last year Pilgrim "put his plan into action" when he abducted the woman at knifepoint in front of friends from a house in Frankston, having used the stun gun on the man who answered the door.
The court heard Pilgrim drove the woman in her car to the rental house - during which he stopped and put her in the boot - and made every effort to take back roads to avoid detection.
Once at the house he chained the woman to the eye bolt and repeatedly raped her over the following days, the court heard.
Mr Sonnet said throughout her ordeal the woman feared she would be killed, although Pilgrim had earlier told her, "I'm planning on keeping you here and using you."
The court heard he made other threats, including: "You better not play up because I really feel like carving someone up today" and "Life's a bitch, isn't it? Unlucky for you."
The court heard at one point Pilgrim told the woman he had put "too much effort into this" to be apprehended.
He also warned her against trying to take her own life by telling her he had tracked her sister, and told the victim he had previously trafficked women in Europe.
Mr Sonnet said the woman suffered severe stomach pain on July 10, 2012, which prompted her abductor to leave her outside a hospital. She stayed in hospital for about two weeks.
The court heard Pilgrim was arrested later that month in Sydney when police used an EFTPOS payment he made at a supermarket to track him down.
Pilgrim has pleaded guilty to 12 charges, including four counts of rape and one each of aggravated burglary, intentionally causing injury, stalking, abduction and false imprisonment.
The court heard Pilgrim had previously served a stint in jail in France for possessing weapons, false documents and an image of child pornography.
On Thursday, Pilgrim sat unmoved for most of the hearing, often looking downward, with his parents in front of him.
His victim, now 25, sat on the other side of court, with supporters. She and her parents had victim impact statements tendered, but they were not read out in court.
Judge Tinney will sentence Pilgrim on August 27. Pilgrim was remanded in custody.

Guilty plea over kidnap and rapes

A former aeronautical engineer who meticulously planned the abduction, imprisonment and repeated rape of a woman he chained up in a purpose-built soundproof room at a secluded Gippsland property has pleaded guilty to multiple offences.
Michael Allen Pilgrim, 34, used false identities, restraints and weapons - knives, handcuffs and cable ties - to commit the ''horrifying'' crimes on his victim.
Highly intelligent, strongly built and well spoken, Pilgrim spent months researching and readying to snatch the woman whom he held hostage over five days last July.
He told her he wanted to hurt her but not kill her. ''No, I'm planning on keeping you here and using you,'' he said as she sat handcuffed on a mattress, her ankle padlocked to a chain attached to an eye bolt in the floor.
Pilgrim appeared in Melbourne Magistrates Court for a contested committal hearing, but pleaded guilty to 15 offences, including four rape charges, false imprisonment, stalking and abduction to detain for sexual penetration.
He was arrested in Sydney on July 20 last year, 10 days after he left his victim outside a hospital in Warragul.
An investigation by the Victoria Police sexual crimes squad found that Pilgrim had been a regular client of the woman, a sex worker, but grew angry with her in February, 2011, after she stopped working and began a ''committed'' relationship.
He then created a false identity ''package'', acquired a Taser, tracking devices and disguises, and researched secluded rural properties to rent.
At a house in Drouin, he built a soundproof room with mattresses within a small bedroom with a large metal eye bolt in the floor.
Pilgrim tracked the woman's movements on a computer from two GPS devices he attached to her car. Her ordeal began on July 5 when Pilgrim, disguised and armed with a Taser, took her from a Frankston house in front of three friends.
The woman told police Pilgrim, holding a gun and knife, drove away in her car and later put zip ties on her legs, shut her in the boot and then after sunset drove her handcuffed into a shed at the Drouin property.
He chained and padlocked her ankle to the floor, she said in a statement, and enclosed her in what she described as a ‘‘cubbyhouse’’ where he raped her four times while restrained.
When he told her he planned to keep her and ‘‘use’’ her, she felt: ‘‘I have a reason for being here, sort of, he has a reason to keep me alive’’.
Pilgrim brought out a heater, blanket and a TV and fed her cereal and instant noodles and twice drove her from the property and returned.
She said she only co-operated with Pilgrim during sex because she was ‘‘so frightened he was actually going to kill me I just went along with it’’.
The woman told police most of the time Pilgrim ‘‘was just sitting there watching out the window on the chair’’.
When she fell ill on July 10, he drove her to the hospital but could not believe he let her out of the car.
She ‘‘actually felt sorry for the guy in the end’’, she said after spending 13 days in hospital. ‘‘I don’t know why.’’
When Pilgrim was arrested in Kings Cross, police found him in possession of weapons, chemicals for homemade explosives, chloroform, disguises and restraints.
Magistrate Phillip Goldberg, who remanded Pilgrim in custody to appear in the County Court on April 16, noted that steps be taken to protect his wellbeing in prison.
