Jail Rape Revealed Mistake, Says Toyne
PUTTING a 19-year-old man in a cell with a serial
rapist was a serious error of judgment, Justice
Minister Peter Toyne said yesterday.
The teenager was raped twice by the man.
The victim will now be told of his rights to claim
victims of crime compensation. He could be entitled
to a payout of $25,000.
Dr Toyne said the system at Territory prisons had
been changed to make sure a similar incident did not
happen again.
Answering a question from Opposition Leader Jodeen
Carney, the minister told parliament prison guards
put the young man in with the rapist because the two
were related. He said the rape was "terrible".
The older man, whose name has been suppressed by the
Supreme Court to protect the identity of the victim,
was sentenced to six years in jail.
Judge Dean Mildren made no recommendation about parole.
The teenager was serving a nine-month sentence when he
was put in a cell with his 42-year-old relative.
The older man had been convicted of three rapes.
In 1995 he was sentenced to six years in jail for raping
a woman at Parap in Darwin. Five years later he got eight
years for raping his sister.
And in 2002 he was imprisoned for seven years for raping
a mentally and physically disabled woman.
Legal sources said the young man had a good chance of
winning the maximum $25,000 compensation.
Correctional Services director Jens Tolstrup has said
there was no reason to believe the teenager was in danger
of being raped.
