Court clears schools
STATE schools should not be held responsible
for the acts of pedophile teachers and staff, the
High Court said yesterday.
In a majority decision, it said an education
authority would only be at fault if it acted negligently or the abuse occurred because the teachers
were doing their duty.
The court decided two cases, one of which was
brought by two former pupils Of former Queensland
MP Bill D'Arcy, who is now in jail for sexual assaults
he committed as a school teacher.
The state of New South Wales brought the other
case after a lower court found it owed a duty of
care to a boy who was indecently assaulted by a
teacher in 1978. In this case the court ordered a
new trial because the first trial was poorly handled.
