Child porn 'Santa' jailed

A man who has worked as a Father Christmas at children's functions has been jailed for downloading disturbing images of child pornography.
Paul James Apostle, 66, of Tailem Bend, in South Australia had worked as caretaker at a children's playground and as a Father Christmas in his home town.
Last year, police found Apostle in possession of almost 2,000 images of pornography involving children as young as three.
Apostle's lawyer told the court that his client had not paid for the images, making it - in effect - a victimless crime.
But chief judge Terry Worthington said anyone who downloaded such images was creating what he called an 'evil' market for child pornography.
He jailed Apostle for two years and three months with a non-parole term of 15 months.

Child porn Santa did little wrong, says lawyer

A former Father Christmas who downloaded 2000 Internet images of children as young as three being sexually abused did little wrong, his lawyer said.
Instead barrister Grant Germein today described Paul John Apostle, 66, of Tailem Bend, as a “peeping tom” who did not pay for the images, and had been caught by authorities like a “tommy ruff in a shark net”.
Mr Germein told District Court Chief Judge Terry Worthington that Apostle was a half-blind reclusive pensioner who “stumbled across the images” while searching the Internet for music.
“It is perhaps less serious because he is peeping at cyber images removed from real persons and even his sense of reality,” he said.
“This man has done no more than look at what was already there without putting forward any consideration (payment) whatsoever,” he said.
Mr Germein urged Chief Judge Worthington not to jail Apostle, saying he only downloaded the images after “curiosity got the better of him”.
Apostle had no sexual interest in the images which depicted children as young as three being sexually abused, including during bondage.
“The material is not of a horribly depraved nature,” said Mr Germein. “There were no babies being raped. There was no depiction of torture or pain being inflicted.
“There is much worse material on the Internet that could have been downloaded if he chose to.”
Mr Germein said Apostle had never been accused of pedophilia while employed as a playground caretaker or as a Father Christmas.
“He had years in the presence of small children without a whiff of any inappropriate behaviour,” he said.
“Hundreds of children have sat on his knees in the presence of their mothers.
“He is not involved in pedophilia, he poses no risk to anyone, children or otherwise and he hasn’t contributed to the maintenance of the porn industry (by paying for the images).
“In fact, to his recollection, he has never owned a dirty book.”
Mr Germein said Apostle downloaded the images, catalogued them and burnt them onto a CD-Rom as “if they were rare specimens of something other people did not have”.
“He didn’t become aroused by viewing them and he didn’t use them to stimulate sexual thought,” he said.
This prompted Chief Judge Worthington to ask Mr Germein: “Why would somebody download nearly 2000 pornographic images of children other than for some form of sexual interest, whatever that degree of interest may be?”
He remanded Apostle on bail for sentencing on a date to be fixed.
“This man has done no more than look at what was already there without putting forward any consideration (payment) whatsoever,” he said.
“It is very much akin to a peeping tom and perhaps less serious because it is less serious.”
Mr Germein urged Chief Judge Worthington not to imprison Apostle, saying he only downloaded the images after “curiosity got the better of him”.
“The material is not of a horribly depraved nature,” he said.

“There is much worse material on the internet that could have been downloaded if he chose to.
“There was no depiction of torture or pain being inflicted.”

“He never entered chat rooms. He has never uploaded anything and he has no association with any group or club or ring given to the composition of pornography of any kind.
