Australia To Deport UK Paedophile
A British-born paedophile who has spent 37 years in jail
in Australia for sex attacks is to be deported to the UK.
Robert Excell, who attacked four boys, would be sent
to the UK "within days", officials in Western
Australia said.
Excell, 66, who emigrated to Australia aged 10
but never became a citizen, is being freed because
of his poor health, age and support from his wife.
Psychologists say he poses a "moderate" risk of
reoffending. He will be put on the UK sex
offenders' register.
Excell had been expected back in the UK as
early as Thursday, but his departure was
delayed as Australian immigration officials
said they would investigate his case.
'Reoffending risk'
Excell's convictions date back to 1965,
when he was jailed for an attack on a
seven-year-old boy.
Since then he has been paroled three
times and reoffended on all three
occasions.
Three years ago the state government
in Western Australia intervened after
a parole board decided to let Excell
walk free.
It said he was such a danger he should
stay in prison indefinitely.
But he will be now released from prison
in Perth before being put on a flight
to the UK.
'Visa cancelled'
Western Australia attorney general Jim
McGinty told ABC radio he was not prepared
to allow Excell to walk free there.
"He's had his visa cancelled. He is not an
Australian citizen," said Mr McGinty.
"He came to Australia many, many years ago
and then very seriously abused the privilege
of residency here by committing the serious
crimes that he did."
The British Home Office would not comment
directly on the case of Excell but said
protecting children was "of the highest
priority" to the government.
A spokeswoman said sex offenders deported
to the UK are interviewed by Special Branch
who "pass any relevant information to the
police in the area to which the offender
is proposing to live".
However, Norman Brennan, director of the
Victims of Crime Trust, called on the Australian
authorities to reconsider their decision to release Excell.
"This individual poses a maximum danger to
children and has committed crime after crime
after crime of the worst degrading types of
paedophilia," he said.

Pedophile To Be Deported
A NOTORIOUS West Australian pedophile is set to be deported
to Britain next month after police ruled out charging him over
the alleged rape of a teenager in prison.
British-born Robert Ernest Excell, 66, had been set to be
returned to the UK in March after WA Attorney-General Jim
McGinty agreed to release him from prison on parole on the
condition that he be immediately deported.
The proposed deportation was delayed while police investigated
a former prisoner's claims Excell assaulted him when he was
an 18-year-old inmate at a maximum-security prison, but today
WA police confirmed their investigation was complete and no charges would be laid.
Excell's parole hearing will now go ahead early next month,
when it seems certain he will be released and immediately flown to the UK under escort.
Today, Mr McGinty said the decision was a difficult one, but
he was not prepared to have Excell free in WA.
"There is no prospect of Mr Excell ever being released into
the WA community. He will be released solely for the purposes
of deportation, and he will be taken straight from prison to
the airport to be deported to Britain," Mr McGinty said.
"Whenever you are dealing with the question of release of
serious prisoners – and Mr Excell has been a serial
paedophile since 1965 in this state – it obviously weighs heavily on you.
"The parole board has recommended his release on parole,
I have said I am not prepared to release Mr Excell into
the WA community. I am however prepared to have him deported."
Excell has spent 37 of the past 39 years in the West Australian
prison system for convictions dating back to 1965, when he
sodomised a seven-year-old boy.
He has been paroled from prison three times and re-offended
on each occasion, but is now considered to be a "low-to-moderate" risk.
John Hammond, the lawyer representing the teenager who
claimed to have been assaulted by Excell in jail,
disagreed with the risk assessment.
"(My client) stands by the allegations he was raped
in prison, that he was raped by Robert Excell and that
Excell is a person who will commit these crimes in or
out of prison," Mr Hammond said.
"(Excell) will be under a home detention program but he
will be free to roam the streets. He represents a danger
to the British community, most definitely."
Sue Walker, the state opposition's justice spokeswoman,
described the decision to deport Excell as a cowardly way out.
"Mr McGinty will have that on his conscience if Mr Excell
rapes again," she told ABC radio.
Mr McGinty said Excell would be met by the British police
on his arrival and would be placed on the Sex Offenders Register,
which will impose reporting requirements on him.

Way Cleared For Paedophile's Deportation
A path has been cleared for the deportation
of notorious Western Australian paedophile Robert Excell to Britain.
The 67-year-old was due to be deported earlier
this year but it was delayed when rape allegations
against him surfaced.
A former Casuarina inmate, who wants to be known as
John, alleged he was raped and abused by Excell in
1992 and again in 1998 while in prison.
A police spokesman has confirmed the claims were not
substantiated in an investigation.
He says police will not pursue any further charges
against Excell.
John's lawyer, John Hammond, says he is disappointed
and understands Excell could be deported within days.

Pedophile's Release, Deportation Delayed
BRITISH-born serial pedophile Robert Ernest Excell will
remain in a West Australian prison as authorities investigate
new claims he twice raped a fellow inmate.
Controversy has surrounded Western Australia's Attorney-General
Jim McGinty's decision to allow Excell, 66, to be granted parole
on the proviso he be deported to the UK.
Mr McGinty said Excell was "low to moderate risk of reoffending",
which meant he posed an unacceptable risk to the WA community, but
he accepted the state parole board's recommendation he be released
and deported immediately.
The decision has sparked outrage in the UK, with a police officer,
a peak UK child protection agency and a pedophile monitoring group
expressing serious concerns through the media.
Excell, who emigrated to Australia from Britain as a child, has spent
37 of the past 39 years in WA's prison system for a string of child
sex offences.
He was originally due to be sent home yesterday but the
process was delayed.
Mr McGinty then said Excell would leave within days, but
serious allegations of rape have since emerged.
A former prisoner, who did not want to be identified, claimed
today that Excell sexually assaulted him in 1992 and 1998 when
they were both inmates at Casuarina prison.
The father of four said he was dragged into Excell's cell when
he was serving a stint for fraud and robbery offences as an
18-year-old.
"After that my pants were pulled down and I was held down and
raped by Excell," he said.
"Straight after that I have got out of the cell and went straight
to the (supervisor's) office and I had about 20
officers come there.
"I told them about it and some of them just laughed at
me and took me down to the medics.
"I was still put back in the same block as
Excell that day."
A medical report was made but the matter went no
further, the man said.
He said he was disillusioned and did not report a
further rape in 1998, in which he said Excell and
two other men put blankets over their heads before
grabbing him and sexually assaulting him.
Lawyer John Hammond said he wrote to Mr McGinty late
yesterday and asked that the deportation process be
delayed while his client's allegations were investigated.
Police confirmed the complaint was being examined and
Mr McGinty's office later issued a one-paragraph statement.
"The Parole Board has today advised that Robert Excell
will not be released from prison on parole before July 1,
2005 because of the possibility of investigations by the
Department of Justice and the WA Police," it said.
Excell's convictions date back to 1965 when he sodomised a
seven-year-old boy.
He has since been paroled three times, reoffending
on each occasion.

Don't Send Rapist Here- UK police
British police last night accused the WA Government of a sickening betrayal
after Attorney-General Jim McGinty decided to grant parole to serial child
rapist Robert Ernest Excell, triggering his deportation to Britain.
Const. Norman Brennan, a veteran officer who is also the national director
of Britain'sVictims of Crime Trust, urged Mr McGinty to rethink his decision,
saying he had no right to put the lives of British children at such risk.
"It shows how much contempt they have for us," he said. "I thought we had a
friendlier relationship with the Australians. This is a betrayal which will
make every British parent sick."
The 67-year-old rapist, one of WA's longest-serving prisoners, has spent 37
of the past 39 years in prison for repeated assaults on young boys.
Two years ago, Mr McGinty rejected a Parole Board decision to release Excell,
saying the safety of Perth's children was a priority. "The risk is far too
great," he said at the time.
"With some people, their offence is so horrific and the damage to others
is so horrific that you can't contemplate their release."
But yesterday Mr McGinty said that Excell's circumstances had changed. "The
fact that he is now old, sick and even the suggestion that he has lost his
sexual functioning (combined) with the fact that he would never be allowed
freedom in Western Australia tipped the balance," he said.
Mr McGinty said the Federal Government had already moved to deport Excell
following a High Court ruling on the serial paedophile.
Police around Britain are bracing themselves for the arrival of Excell, who
is due to be released from Acacia Prison today and flown to London
within 48 hours.
As soon as he lands, his details will be posted on the national sex
offenders' register.
"As if the rape of one child is not bad enough. How many more children
have to have their lives destroyed before they and the rest of society
are protected? How can the Australians say this man is an absolute danger
and we don't want him in society but then be prepared to release him to
another country?" Const. Brennan said.
Excell was first jailed in 1965 after he sodomised a seven-year-old boy.
He was released on parole in 1973 but raped a nine-year-old boy within
days. In 1977, he was granted parole again but was convicted of raping
a 13-year-old boy four months after his release.
Excell last tasted freedom in 1981 but within 18 months he was charged
with indecently dealing with a boy under 14 years of age, two counts of
deprivation of liberty and one count of assault. He was detained at the
governor's pleasure.

Paedophile's UK Move Postponed
A British-born paedophile due to be deported today from
Australia will remain behind bars there - at least for now.
Immigration officials stepped in at the last minute to
block the deportation from Perth to England of 66-year-old
Robert Earnest Excell.
It came after Western Australia's attorney-general Jim
McGinty agreed to release Excell on condition he was
immediately repatriated to Britain, where he lived until
he was 10.
Mr McGinty had previously refused Excell parole because
he still posed a danger to children.
Excell, who is married, has spent 37 years behind bars for
four separate convictions of sexually abusing and molesting
boys as young as seven.
When freed on good behaviour in the past, he has preyed on
little boys and committed similar crimes. Even his wife said
she would not leave her grandchildren alone with him.
The federal immigration department's decision to step in means
Excell will remain in prison until a final decision on deportation
is taken.

DEPORTING EXCELL- You could safely say, what politician in their right mind would
give a convicted sex offender a visa...political suicide and you would have
every paedophile from around the world applying for one !!
It is a catch 22 with current legislation. Excell should not be released in the first place.
The W.A Government are saying they will not release him into an Australian
community to molest again.
They recognise the dangers he (paedophiles) poses to children, so why release him
then- EVER!! Australia needs to introduce legislation to jail paedophiles/ sex offenders
who re-offend for life- Keeping them away from children for good- Why risk another child
being abused..?? Many would say ,jail them for life after first conviction...
Releasing him into an unsuspecting community to possibly molest another
Australian child would be inexcusable and unfortunately current Australian laws are allowing many
1000's of child sex offenders to live secretly in Australian communities to possibly
strike again-
see community notification..
While you can understand the UK not wanting him back, we do have enough sex offenders here
in Australia already, and unless he is locked up for good (as he should be in our humble opinion)
he is a UK citizen, not an Australian and has no right to be here, except in a cell.

However, according to an Australian news reports the
deportation will not go ahead until government
authorities have reviewed his case.
Excell is reportedly regarded as one of Western
Australia's worst child abusers, with four separate
convictions for sodomising and molesting young
boys, dating back to 1965.

reoffended on all three occasions.
In November 2002 the state Government intervened
to force him to remain in jail indefinitely, overruling

to England but he would much rather be in Australia where
he has lived all his adult life ... and most of his
childhood," Mr Magnus said.
Mr Magnus said Excell is unlikely to re-offend. He said: "He is
no more capable than you or myself or anyone."

But he will be immediately deported to the United Kingdom, WA

worst child abusers, with four separate convictions for sodomising
and molesting young boys.
In November 2002, the WA Government intervened to force Excell to
remain in jail indefinitely, overruling a Parole Board decision
to let him go free.
But Mr McGinty today indicated he had changed his mind, consenting
to Excell's release tomorrow on the strict condition he be
immediately deported.
Excell will tomorrow be taken from Perth's Acacia prison directly
to immigration detention at Perth's airport for processing before
being put on the first possible flight to UK.
"He cannot be released into the West Australian community and
will not pose a threat to the West Australian community," Mr
McGinty told ABC radio today.
"He's had his visa cancelled. He is not an Australian citizen.
He came to Australia many, many years ago and then very seriously
abused the privilege of residency here by committing the serious
crimes that he did."
