Child sex abuser Neil Thomas Spurr escapes life in jail
THE Supreme Court has ruled repeat child abuser Neil Thomas Spurr is not an "uncontrollable sex predator" and should not be jailed indefinitely.
Justice Richard White, however, today ordered the 41-year-old serve a minimum three-year term for two years' worth of assaults on teenagers in his neighbourhood.
He said Spurr's actions were deserving of the community's "outrage and revulsion", particularly given his lack of remorse.
"You have denied any wrongdoing, just as you did when you were jailed for similar offences in 1992," he said.
"You continue to maintain your innocence, and you have made no expressions of remorse or contrition.
"I cannot extend any leniency toward you."
In September 2007, a jury found Spurr guilty of eight counts of indecent assault.
All of the offences were committed in his Andrews Farm home, against two brothers who lived in the area, in 2004 and 2005.
In sentencing today, Justice White said Spurr became friends with the boys' parents.
After he was trusted enough to take care of them overnight, he began to fondle and abuse them.
"On seven separate occasions you indecently assaulted these two young boys, on one occasion assaulting them both at the same time," he said.
"It was selfish behaviour carried out with no regard to the damage that would be caused to the boys.
"You have numerous opportunities to reflect on your conduct and its wrongfulness, but you did not do so."
He said Spurr's history of sex offences began with a 12-month bond, imposed when he was a minor, for unlawful sexual intercourse.
In 1992, he served time for abusing a boy whose parents had entrusted him with his care.
"That sentence should have brought home to you the serious offences of offending of the present kind," he said.
He ordered Spurr serve six years' jail with a three-year non-parole period.
There was not, however, sufficient psychological evidence to rule him an uncontrollable sex predator

Indefinite Detention Urged for Sex Offender
A man who was found guilty of sexually abusing two young boys has had his case referred
to the South Australian Supreme Court to decide if he should be detained indefinitely.
Last September, Neil Thomas Spurr, 40, was convicted of eight counts of indecent assault
involving two boys, committed between 2004 and 2005 in Adelaide's northern suburbs.
The prosecution argues Spurr was referred to a sex offenders' treatment program but did
not 'engage' and had not accepted responsibility for his crimes.
The hearing was told that if Spurr were sent to jail he would serve his sentence, then be
released without having had any treatment - putting him at risk of re-offending.
Judge David Smith referred the matter to the Supreme Court to assess if Spurr is capable
of controlling his sexual urges and whether he should be detained indefinitely.

Repeat Pedophile Neil Spurr 'Should be Jailed Indefinitely'
A REPEAT pedophile who refuses to admit his crimes is an uncontrollable sexual predator and
should be jailed indefinitely, a court has heard.
Prosecutors today asked the District Court to refer the case of Neil Thomas Spurr to the
Supreme Court so application could be made to jail him until further order.
They said top pedophilia experts feared Spurr would reoffend if not forced to undertake
some form of treatment.
George Mancini, for Spurr, argued the move was unnecessary – but failed to sway Judge
David Smith.
"He's got previous convictions for this, he was convicted by a jury in front of me, a
psychiatrist has told us he's a risk of reoffending, and you stand here and say to me
there's no evidence to justify this application?," he said.
"I'm against you, Mr Mancini – I think this is as plain as the nose on your face."
Spurr, 40, of Andrews Farm, was last year found guilty of eight counts of indecent assault.
A District Court jury ruled he had committed sex crimes between May 2004 and March 2005.
He previously served a 12-month jail term for three counts of indecent assault and one
count of common assault.
Today, Karen Ingleton, prosecuting, said Spurr's case should go to a higher court.
"He has prior convictions for sex offences against children and has never accepted
responsibility for his current offending," she said.
"He has not engaged in the Sexual Offenders' Treatment Program following his prior
offending and there is a real risk he will be released again, after serving time
for these offences, with no treatment.
"Psychiatrists from SOTAP have reported that he poses a significant risk, a high
risk, of reoffending."
Mr Mancini said his client should be sentenced in the District Court.
Judge Smith rejected that suggestion, remanding Spurr on continuing bail to
appear before the Supreme Court on a date to be set.
