Mine-shaft Rapist Fails in Discrimination Claim A rapist who held his teenage victim captive in a disused mine shaft has failed in a discrimination claim over his treatment by police after arrest. Appearing at the Victorian Civil and Administrative Tribunal by videolink from Ararat prison, Anthony James Pitt, 52, said police tried to coerce him to plead guilty, and stirred up other prisoners against him at the holding cells in Ballarat. Pitt is serving a 17-year jail sentence, with a 15-year minimum, after pleading guilty to two rape counts, and one of false imprisonment. Police found him and the girl in the mineshaft after she was reported missing in November 1998. In a hearing today before tribunal deputy president, Judge Marilyn Harbison, Pitt said one policeman caused other prisoners at the cells to give him a hard time by saying he had raped a girl. He said the prisoners were also invited to spit in his food before it was served to him. When he asked for a drink of water, another officer allegedly threw him a cup and told him to get the water from the toilet. Pitt said the first policeman told him that he had "better plead guilty" so the officer did not have to give evidence. "They knew that I was mentally ill and they made fun of it,'' he said. He said he had a history of mental illness, which would have been known to police. He was also prescribed anti-depression drugs. Judge Harbison said Pitt had to establish in his claim under the Equal Opportunity Act that the mistreatment occurred, that he had an impairment and that the two were connected. She said in dismissing the claim that she would not make a finding about whether his evidence was true, but there was no material connecting the alleged conduct with his impairment.
