State: QLD- Inala Sentence: Sentenced in the Brisbane District Court in Dec 1996 to 13 yrs jail..Was released from jail on the 7-12-2010 Offence/Other: Pleaded guilty to rape/ assault.Victim was a 14yr old girl (Rachael). Rachael was followed after a night out skating and savagely attacked and raped by Costello.. Rachael later committed suicide in Dec 1996 aged just 15... Costello was already on parole for robbing and attacking a pregnant woman (with a baseball bat in her own home), at the time of the attack on Rachael.
The Judge at the time
said,"In my opinion he presents a significant danger when living at large
in the community....."

Attacker's release from prison upsets rape victim's mum THE mother of a 14-year-old girl who took her own life after being raped has expressed concerns at the release of the girl's attacker today. However, after examining all the evidence a judge found Darren Michael Costello should be allowed back into the community but under strict monitoring conditions. Costello has spent nearly 15 years in jail for the rape and other offences committed in the mid-1990s. He will be released today on a strict supervision order under the Dangerous Prisoners (Sexual Offenders) Act 2003. A letter written by the mother of the victim expressing concern about the release was tendered to a Supreme Court hearing in which the Attorney-General Cameron Dick applied for an order under the Act. However, after taking other evidence, including reports from three psychiatrists, Justice Debbie Mullins agreed to release Costello, now 39, under a strict supervision order. Justice Mullins said she had great sympathy for the victim's mother but had to take into account all of the evidence, some of which did not support the mother's worries. She said psychiatric evidence showed Costello, who had a low IQ, was not a pedophile but steps had to be put in place to ensure Costello did not use drugs or alcohol. Justice Mullins said she believed Costello would be a danger to the community if he was released without a supervision order. Costello was jailed for 13 years in December 1996 but did not begin his sentence until January 1998 because he was on parole for other offences when he attacked the teenager. In the District Court in Brisbane, Costello pleaded guilty to rape, disabling with intent to commit a crime, indecent assault and assault occasioning bodily harm. The hearing was told the girl hanged herself three days after the attack. She had taken a shortcut through a creek bed to meet friends who lived near the Inala skating rink, in Brisbane's southwest, when attacked by Costello. At the time, the judge lifted the usual restriction on the naming of rape victims at the request of her family. However, Queenland's laws have since changed again meaning the victim can't be named. Costello had a criminal history for violence including the sentence he was serving on parole at the time of the attack. Parole was recommended for 2004 but Costello did not receive it and served his entire sentence. Justice Mullins ordered the supervision continue until 2020. The Courier Mail (7-1-2010) |
