State: NSW Sentence: Sentenced in 1993/4 to life in jail. Never to be released. Offence/Other: Abducted, sexually assaulted then murdered 9 yr old schoolgirl Ebony Simpson...Ebony was taken from Arina Rd, Bargo, N.S.W, after getting off the school bus to walk the short distance home. Garforth put Ebony into the boot of his car and drove to a dam at Wirrimbirra Sanctuary, where Ebony was sexually assaulted, then drowned. In court he showed no remorse for his actions. In 1996, N.S.W, Premier Bob Carr, launched Ebony House. A place of safety for the families of victims of homicide. Garforth has also tried to seek compensation for "bashings" he received in jail. |

It is 10 years since the tiny township of Bargo was rocked by the callous murder of one of its children. Nine-year-old Ebony Simpson was abducted after getting off her bus on the way home from school on August 19, 1992. Locals and emergency services joined in an intensive search for the missing youngster before Ebony's mother Christine Simpson's worst fears were realised. The defenceless schoolgirl had been bundled into the boot of a waiting Mazda 808 sedan and driven to a nearby dam. Her hands and feet bound with speaker wire, she was sexually assaulted by Andrew Peter Garforth. He then threw her into the dam, still bound, and listened to her scream as she drowned. Then he stuffed her schoolbag with rocks and threw it into the dam. He then left. Ebony, an accomplished swimmer, had no chance of reaching the shore. The following day Garforth joined about 150 locals who were assisting police in the search for the missing schoolgirl. That night he was interviewed and stunned police with his casual manner and graphic description of events. Justice Newman, the Supreme Court judge who presided over Garforth's trial, said Ebony's last moments must have been spent in abject fear. It was a 'worst category case' - for only the fifth time in NSW, to which Garforth simply had no defence or explanation. Twenty nine-year-old Garforth was sentenced to jail for the term of his natural life. Justice Newman described him as heartless. "Again, as I noted earlier, his callous and casual comment as to what he would have expected to happen to his victim as she struggled in the water is chilling to the extreme," Justice Newman said. Garforth had been charged with 76 offences and convicted on 41 occasions. He and his family had been relocated from Western Australia to Picton and St Vincent de Paul moved them from Picton to Bargo. He had lived just 3km from Ebony's home for just five weeks and had stalked her. Her future was wiped out in 25 minutes. On December 7, 1994, the NSW Director of Public Prosecutions wrote to Christine Simpson to formally advise her the High Court had refused Garforth special leave to appeal against his sentence of life imprisonment. "There is no other avenue of appeal available to the prisoner," the DPP said. "The sentence requires that he be imprisoned for the term of his natural life." On 19 August 1992, Simpson disembarked from her schoolbus and walked past a parked mazda 808 vehicle owned by Garforth. Garforth abducted her, put her in the boot, and drove to a remote location near Wirrimbirra Sanctuary. He sexually assaulted her repeatedly, bound her, weighted her schoolbag and threw her into a dam where she drowned. A team of over 200 volunteers and 100 police searched for Simpson, including her killer. Garforth confessed to the crime after police detained him; during the confession and court sessions, Garforth showed no remorse for his actions. He pleaded gulity to the murder of Ebony Simpson and was sentenced in 1993 to life imprisonment; Justice Peter Newman refused to fix a non-parole period and ordered that his papers were to be marked "never to be released". In discussion of the meaning of life imprisonment in relation to this case, the judges in the case of Garforth when that was appealed, said "the community interest in retribution, deterrence, protection of the community in such situations may so strongly outweigh any regard for rehabilitation that that's when a life sentence becomes a real option."[1] In 1995, Garforth lodged several claims for victims' compensation via his lawyers, Brezniak Neil-Smith and Co., relating to alleged assaults which occurred in prison. The claims were later withdrawn after public outrage. Garforth appealed to the High Court of Australia, but he was refused special leave. It is one of two similar cases, both of which have been refused special leave.[2] Andrew Peter Garforth is also suspected of the unsolved 1979 murder of West Australian teenager Felicia Marie Wilson, 19, of Kwinana, Perth. Miss Wilson, a former Miss West Coast finalist, was stripped naked and slashed before her killer smashed her skull with a 27 kg block of limestone as she walked home from work at the Kwinana Community Health Centre about 4.30pm on January 10, 1979. The manhunt went cold until the early 1990s when WA detectives received information from NSW police about a man who reportedly had nightmares about Miss Wilson. By 1994, NSW police had further information about Miss Wilson's death that linked Garforth, who lived in the area at the time, to the unsolved crime.
