Other:
Chef/cook...Sims pleaded guilty to 2 counts of rape/ indecent assault/ aggravated burglary..broke into his victims (22yr old woman) residence and sexually assaulted her.
Incredibly the Judge wished the offender well- not the victim.......

Young Rape Victim Angry At Sentence
A young rape victim said yesterday she felt like a fraud after her
attacker left an appeal court with
a suspended sentence.
Speaking at her suburban flat,
the woman, 22, said her life had
been turned upside-down after
chef David Leslie Sims, 36,
entered her home and raped her
on November 30 last year.
She said she was disappointed
and angry when the
Court of Appeal, in a split
decision yesterday, dismissed a
prosecution appeal against the
suspended sentence Sims
received for the rape.
"I care about rehabilitation,
it's for the good of society ...
but, Jesus Christ, it's (rape) not a
petty crime, "she said. "I wish
he would have been punished
accordingly and by not doing so,
it somehow makes me feel like what
happened isn 't really looked upon as being that
serious".
In April this year, Sims, formerly of St Kilda, was given a
susupended jail sentence of two
years and nine months, after
pleading guilty in the County
court to two rape charges, one
count of indecent assault and
one of aggravated burglary.
Judge Tony Duckett said in
sentencing that Sims, after
drinking beer and taking marijuana and ecstasy, saw the
woman asleep in her lounge room. Sims opened the door to
her flat and raped her orally and
digitally. The woman fought to
stay calm and polite, while asking
him to leave. Sims left the flat
and was later found asleep, and
intoxicated.
Judge Duckett said in April
that Sims pleaded guilty to the
charges, showed remorse and
had good rehabilitation prospects. Describing the offences as
serious, Judge Duckett said Sims'
actions were a spontaneous response to an unusual situation
and his inhibitions were reduced
by his alcohol and substance
abuse.
He took account of Sims'
reputation as a hard-working and
responsible person in suspending the jail sentence.
Yesterday, in the Court of
Appeal, justice Geoffrey Eames
said the woman must have been
terrified, and displayed considerable fortitude as she endeavoured not to show fear.
But he and justice Frank Vincent dismissed the appeal by the Office
of Public Prosecutions.
Justice Eames said a suspended sentence did not mean an offender
had not been punished. He said
Sims had to live with his admission that he was a rapist, and had
spent 38 days in custody.
Justice John Batt said in a dissenting Judgement that the sentence fixed was lenient and he
would have ordered immediate
imprisonment.
Yesterday the woman said she
had not left her home for a week
after the attack and eventually
quit her job. She felt vulnerable
and had withdrawn from some of
her friends after being raped. "I
feel like now I've probably suffered more than he has," she
said.
