State: VIC- Sunshine Sentence: Sentenced in Nov 2004 in a VIC Court to 10yrs jail. In a separate incident- Convicted of 10 charges- Including false imprisonment/ indecent assault. Sentenced in Feb 2005 to an extra 15 months jail. Sentence was appealed in August 2005 and the 15 month sentence was increased to 4yrs jail. Offence/Other: Repeat offender..Charged and convicted of rape in 2004. Victim was a woman. As the victim walked home from a nightclub in Sunshine, Vivona bashed/ raped her in a garden in Albion. In a separate incident, while he was on bail for the rape, Vivona, posed as a police officer, knocked on the door of 2 female students in their Melbourne home. Armed with a knife and duct tape he bound/ sexually assaulted/ robbed the women. |

A MAN who indecently assaulted two Japanese students at knifepoint after knocking on the door of their Melbourne unit posing as a policeman has been sentenced to further imprisonment. Luigi Vivona, 35, bound the women and touched their genitals and breasts before robbing them in Yarraville last July. He was today jailed after being found guilty earlier in the Victorian County Court of 10 charges, including indecent assault, false imprisonment, aggravated burglary and armed robbery. Judge Barton Stott sentenced Vivona to serve a further 15 months in jail on top of a 10-year term he is serving for rape. With time served over the latest charges, Vivona, formerly of Hawthorn Street, Yarraville, will spend an extra three-and-a-half months in jail. The judge said Vivona, a father of three, was armed with a knife when he bound and gagged the women before dragging them into separate rooms. He then touched the women, who were Japanese students, on the genitals and breasts before stealing their mobile phones and about $500 in cash. He said Vivona, who had abused drugs and alcohol in the past, was not under the influence of drugs at the time of the crime, which happened at 2.30am on July 12. "The circumstances show that your attendance at the scene with a knife and duct tape was premeditated and predatory," he said. A MAN who bashed and raped a woman in a front garden initially avoided prosecution to allegedly strike again. Luigi Vivona, 34, escaped immediate justice because his terrified victim declined to proceed with the prosecution after he threatened to kill her. Vivona raped the woman as she walked home from a Sunshine nightclub in November 2002. Free to roam the streets after the prosecution stalled. Vivona — posing as a policeman — allegedly struck again eight months later. In July last year, he allegedly knocked on the door of a Yarraville home and told its two female occupants he was a police officer responding to a call. It is alleged that when the door was opened he threatened them with a 20cm knife, bound them with silver duct tape and sexually assaulted them before escaping with cash. The case has sparked calls from angry victims' advocates, including Crime Victims Association president Noel McNamara, for better support for people struggling to cope with sex attacks. "It's no wonder she didn't want to proceed with the prosecution because she thinks she will be victimised again — as all rape victims are in the courts," he said. "They get embarrassed through tough questioning and the blokes (the accused) walk free or get let off with a light sentence. "The police do a magnificent job. They get the evidence, they put the case together, then everyone gets let down with the sentence." Vivona admits forcing himself on a woman he saw at a Sunshine nightclub on November 16, 2002. He saw her walking tiome about 1.30am. He offered to walk with her before hitting and raping her in a garden in Gunnedah St, Albion. Residents heard the struggle and called police, who detained Vivona. Police found his traumatised victim staggering home with blood smeared across her face. She claimed she had been threatened and told to "shut up", so she was reluctant to proceed with prosecution, leaving Vivona free. "When it was happening, he said to me if I don't shut up, I was going to die," she said in her victim impact statement. In an interview with police, Vivona claimed the woman had shown an interest in speaking to him at the club. He believed she was telling him "no" as he raped her because she feared her boyfriend, who had gone home earlier, would catch them. Indecent assault carries a maximum sentence of 10 years' jail. The maximum for rape is 25 years. Vivona, of Sunshine, was remanded in custody over the 2003 alleged invasion and assault, and charged by summons over the 2002 rape. He has pleaded guilty to the rape charge and will be sentenced in the County Court on Tuesday. Vivona has reserved his plea in the matter of last year's alleged attack.
