A SECOND notorious sex offender is under police investigation for possessing child pornography in prison. The Sunday Mail has learned that Anthony James Wheatman – one of the State's worst pedophiles – is a key player in the investigation that resulted in convicted murderer Bevan Spencer von Einem being charged with child pornography offences. Wheatman's cell at Port Lincoln was searched by police last Thursday morning at the same time von Einem was arrested at Yatala Labour Prison. A Port Lincoln Prison source said police seized a quantity of material from his belongings after searching his cell. "They appeared to know exactly what they were looking for," the source said. "One seemed fairly interested in some of the stuff he found and said it would be sent to Adelaide to be examined." Sexual Crime Investigation Branch officer-in-charge Detective Superintendent John Venditto, who is leading the von Einem investigation, declined to comment on the development yesterday. "As the investigation is ongoing and a person is before the court, it is inappropriate to discuss any aspect of our activities," he said. Wheatman, 40, was convicted in the District Court in December 2000 of 24 counts of indecent assault and unlawful sexual intercourse involving seven boys, the youngest aged just five. He was originally sentenced to 10 years' jail with a non-parole period of five years, but then-Director of Public Prosecutions Paul Rofe, QC, appealed against the leniency of the sentence. In August 2001, the Full Court of the Supreme Court set aside that penalty and imposed a fresh 16-year sentence with a non-parole period of nine years. Wheatman was held in Yatala's B-Division until he was shifted to Port Lincoln last year as part of his pre-release program. He can apply for parole in 2009. The Sunday Mail has also learned von Einem, 61, has been shifted from his B-Division cell and placed in isolation at Yatala following his arrest. He was placed in the top security G-Division – which holds inmates such as convicted terrorism supporter David Hicks – immediately after he returned from Adelaide Magistrates Court late on Thursday. Correctional Services sources said he had been transferred to ensure the "good order" of the prison. He would remain there – spending 23 hours a day locked in a sparse cell – pending a future assessment. Von Einem was arrested by SCIB detectives following a lengthy investigation, which was revealed by the Sunday Mail last week. He has been charged with producing child pornography and possessing child pornography. The charges relate to handwritten "stories" which allegedly describe in graphic detail the abuse of young boys and which were allegedly found during a search of his cell by detectives who were investigating his alleged rape of a fellow inmate. When von Einem appeared in court, his lawyer Sam Abbott told Magistrate Peter Wilson that von Einem did not write the material and that it was being analysed by a handwriting expert in an effort "to prove this". Mr Wilson remanded von Einem, who is serving a 24-year non-parole period for the murder of Richard Kelvin in 1982, to reappear on September 21. The charges against him are believed to be the first using new laws introduced in 2004. The Criminal Law Consolidation (Child Pornography) Amendment Bill essentially moved child pornography offences from the Summary Offences Act into the Criminal Law Consolidation Act where higher penalties applied. When introducing the amendments to State Parliament, Attorney-General Michael Atkinson said child pornography was "a heinous exploitation of children and the demand for such materials fuels its production and supply". "The purpose of these amendments is to reduce and, as far as possible, eliminate the possession, production, supply and sale of child pornography," he told Parliament. The amendments increased the penalties for the offence of possession of child pornography and for the production or dissemination of child pornography to five and 10 years' jail respectively. While he emphasised he was not commenting directly on the von Einem case, Superintendent Venditto said the public may not be aware of the extent of the legislative changes and the ramifications for people who produce and possess child pornography. "The public should be aware that people who write or even possess this type of material and have access to children may well be a risk to them," he said. "If anyone has any knowledge of anyone in possession of similar documents or other child pornography, they should contact CrimeStoppers."
